1. Digital Acceptance & Binding Consent (R.A. 8792)
By ticking the acceptance checkbox on our inquiry form, the Client acknowledges these Terms. A binding contract under Republic Act No. 8792 (Electronic Commerce Act of 2000) is formed when the Client approves a formal quotation, in writing or electronically, and pays the required deposit.
- Electronic approvals, digital signatures, and electronic records have the same legal effect as handwritten signatures under Philippine law.
- An individual acting on behalf of a corporation, interior design firm, or general contractor warrants full legal authority to bind that party.
2. Custom Fabrication & Finality of Custom Orders
Every fixture produced by Bespoke Lighting Solutions is custom-engineered and fabricated to client specifications.
- Finality: Once shop drawings, 3D renders, or material specifications receive written client approval and production or procurement begins, orders cannot be cancelled, and refunds are not given for change of mind, change of design preference, or ordering errors by the Client. This does not affect the Client's rights under Section 6 and Republic Act No. 7394 in case of a manufacturing defect.
- Revisions & Delays: Requests for dimensional, electrical, finish, or design changes after approval will adjust production timelines and incur additional fabrication charges. Site-access restrictions, delays in client-provided specifications, or delayed milestone payments will extend delivery commitments accordingly.
3. Artisanal Craftsmanship & Material Tolerances (R.A. 7394)
All bespoke lighting pieces use artisanal manufacturing processes, including handblown glass, cast acrylic, custom metal extrusions, and specialized hand-applied finishes.
- Inherent Material Characteristics: Natural variations such as micro-bubbles, minor striations, subtle optical thickness variations, color gradient shifts in handblown glass, and minor textural differences in treated metals are inherent hallmarks of custom craftsmanship, not manufacturing defects or non-conformities.
- Subjective Aesthetic Preferences: Minor variances from digital mockups, screens, or 3D renders do not constitute a defect or failure of warranty. Subjective dissatisfaction regarding aesthetic preference, ambient light cast, or color temperature perception does not qualify for return, replacement, or price adjustment.
4. Structural Mounting, Seismic Hazards & Installation Liability
Bespoke Lighting Solutions designs and fabricates lighting hardware. The Client and their licensed structural engineers or contractors bear responsibility for verifying the load-bearing capacity of the installation point.
- Prohibited Substrates: Direct fastening, hanging, or anchoring into gypsum board, acoustic ceiling tiles, drywall, fiber cement board (HardieFlex), or any non-load-bearing ceiling substrate is strictly prohibited.
- Mandatory Substrate Anchoring: Heavy custom fixtures must anchor directly into solid reinforced concrete slabs or dedicated secondary structural steel supports engineered to carry the dynamic load of the fixture.
- Seismic Compliance: All installations must comply with the seismic provisions of the National Structural Code of the Philippines (NSCP 2015) applicable to the project site's seismic zone (Metro Manila and most of the country fall under Zone 4). Fixtures must account for lateral sway, building drift, and seismic acceleration. Bespoke Lighting Solutions disclaims liability for structural failure, ceiling collapse, or personal injury resulting from improper anchoring, unverified ceiling substrates, or inadequate seismic bracing executed by third-party installers.
5. Installation Scope & Site Preparedness
Where installation coordination or complimentary mounting assistance is expressly agreed upon in writing:
- Site Readiness: The site must have clean, unobstructed access; safe scaffolding or mechanical lifts where ceiling heights exceed standard step-ladder limits; verified load-bearing ceiling anchor points; and fully tested electrical junction boxes with a stable voltage supply.
- Abortive Visits: If installation cannot proceed upon arrival due to unfinished ceiling works, hazardous site conditions, lack of electricity, or unmet structural mounting prerequisites, an abortive mobilization fee will apply, and installation will be rescheduled based on factory capacity.
6. Warranty & Limitation of Liability
- Warranty: Bespoke Lighting Solutions warrants its fixtures against internal electrical assembly failure and factory fabrication defects for one (1) year from the date of handover. Within this period, we will repair or replace the defective component, or refund it if repair or replacement is not possible.
-
Exclusions: This warranty does not cover damage caused by:
- Power surges, improper grounding, low voltage, or uncertified electrical wiring.
- Anchoring failure, substrate degradation, water leaks, or seismic displacement.
- Alterations, field modifications, or repairs by unauthorized personnel.
- Use of abrasive cleaning chemicals on specialty metal platings or glass coatings.
- Limitation of Liability: To the extent permitted by Philippine law, total liability for any claim arising from the design, sale, delivery, or installation of a product shall not exceed the contract price actually paid for the specific fixture. This limit does not apply to liability that cannot be limited by law, including damage caused by product defects under R.A. 7394, fraud, or gross negligence.
7. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Nothing in these Terms removes or limits any right the Client has under Philippine consumer protection laws. Any dispute shall be filed exclusively in the proper courts of Pasay City. If any provision is found invalid, the remaining provisions remain in full effect.
